police should confiscate the vehicle.

The vehicle is supposed to be under the custody of the police
Adv. Vaishali Harish Gore (Expert) 07 August 2019
If you want to be legally safe , then you always required legal proof, If Police allowed to keep vehicle , then take note from police for such, which they may not give. If any thing in writing given by the police then there is no harm to keep. (but check the content properly)

Dear Sir,
The police have to seize the vehicle under a Panchanama and they have to file PF to the Court seeking permission to return the vehicle with them and they cannot give the custody to the President.
