Up: land in nagar nigam area but classified as agriculture

In state of UP the area belonging to Varanasi nagar Nigam is still classified as agriculture land. Though on this land houses are built and municipal tax is collected.
Why this dichotomy?
Local agents say the Urban notification is required to convert land use. Is the opinion correct.

Change of land use is not necessary qua such land as such land vests in almost all Nagal Palikas even in Haryana. Such land is marked as Gair Mumkin in land record which means that the same is meant for residential purpose.

A bhumidhar has right to change nature of use of his agricultural land and can raise constructions subject to permission of local regulating authority and these changes should be taken in note of lekh pal reportable to tehsildar who in turns to SDM
and accordingly AABADEE user should be recorded but corruption is the barrier,an application is awaited from owner.
