Dear Expert
I have a situation here my client had acquired in yr 2004 a small shop in the slum area of mumbai the said plot on which the slum is located belongs to MHADA ... which comes under CRZ-3 my client had evidences and document that the said structure in b4 1995 due which he got Photopass (commercial)issued by MHADA later on our client came to know from MHADA officials that MHADA had proposed to give 1/2 part of our client premises ie arnd 250 sqft to Police but MHADA said Police has not completed the proper paper work and formalities ..since then our client shop was closed in yr 2006 he decided to repair and start the shop but police came and forcefully took the possession of the half part and harassed my client many times Even now police is in possession of the said half part Now my client wants to get the possession back how to go about it.....
My client is paying MHADA lease Rent which come in his name Currently police r using electricity from our client.

Your client should have filed even a criminal case against the erring officials of police but he failed to do so and now the only option remains to file a suit for possession against the police in the light of payment of regular rent by him as well as his continuous possession thereto as allotted by MHADA.

I endorse the opinion of Shri Makkad.

Ok..... But the suit of possession will take a long time to settle in court is there any other way to expedite it fast
Further my client has put forward an argument that the said part of shop was given to police on friendly terms and MHADA has not Alloted to them Nor Police have completed their part of paper work ..... with MHADA or BMC how strong `this argument will stand before court?
