(Querist) 05 May 2012 This query is : Resolved
hi i want to know weightage to non judicial stamp paper in court of law as my wife's bro has sign two affidavits one is in her favour & second unfavourable on same day, same presedency magistrate. now my question is which is valid in court. thanks
V R SHROFF (Expert) 05 May 2012
ALL AFFIDAVITS ARE INVALID IN COURT, unless the Deponent is examined.
Whatever he says there, and withstand his cross exam, will be VALID., AS IT IS PROVED, AND READ IN EVIDENCE.
ajay sethi (Expert) 05 May 2012
affidavit of evidence has to be tested in cross examination

thanks to shroff v r saheb.

I agree with the Ld. Shroff. However, his previous statement under oath would be binding on him.
