When to file the application under section 340 of cr.p.c. for perjury?

my contempt petition is at the stage of final hearing. The respondent have submitted the affidavit which contained many false statements. I have the documentary evidences to prove it. can i take the leave of the court at this stage to file the counter affidavit? And when should i file the application under section 340 of Cr.P.C? is there need of leave of court to file this application? My advocate is not co-operating well with me so please suggest me.
