(Querist) 19 April 2014 This query is : Resolved
A person retired from the post of clerk from the office of west Bengal government but after two years his retirement benefits including pension( save and except P.F.) has not be given in spite of repeated letter. where he has to move either high court Calcutta or West Bengal Administrative Tribunal?
Devajyoti Barman (Expert) 19 April 2014
He will have to file Writ petition in Calcutta High Courts.
The Calcutta high court is over burdened with writ of this nature only.
Rajendra K Goyal (Expert) 20 April 2014
Agree with the experts, if no outcome of repeated reminders file writ petition in high court.
V R SHROFF (Expert) 20 April 2014
Carry on, engaging Shri Barman.
As Adv Barman knows the rule in WB better than us. Being Local Adv, it is the best move..

Has he applied for Pension, Gratuity, PF, etc., on prescribed forms to his office?
T. Kalaiselvan, Advocate Online (Expert) 21 April 2014
If there is an inordinate delay in disbursing the said terminal benefits, and there seems to be nothing fruitful on the anvil, the next approach may be through a process of law and as advised by experts, a writ petition seeking direction to disburse the said terminal benefits expeditiously will be the next alternative.
