If someone purchase shop in the mall and lease it to other person is shop owner can be sued as consumer under consumer protection act. is shop owner be treated as consumer?

Your query is a bit confusing. You want to file a complaint agasint the shop owner or shop owner wants to file a complaint agasint the builder?

Shop owner who has bought a shop in the mall and is availing certain facilities/common services for his trade is not consumer as the activity is commercial. One can be a consumer of shop owner.
