Section 125 of CrPC deals with the order for maintenance. Following are the steps involved:-
- Submit Application explaining the facts and other relevant details pertaining to the case.
- The court then issues notice to the Husband.
- Parties are then requested to appear before the court in a particular date and effort is made to reconcile the couple.
- The matter is settled if the reconciliation process is successful. If not, the petition is heard on merits.
- The Court then directs the respondent for a written statement. Then issues are then framed and the matter is posted for evidence.
- Both petitioners and respondents are asked to provide evidence pertaining to the matter.
- After hearing both sides, the court finally passes the order/judgement.
