In a 138 complaint, complainants version is that the accused asked the loan of an amount, then the complainant asked the accused to collect the said amount from his father from his house and instructed his father to give the amount to the accused.. Whether the case under section 138 will stand. Pls reply

If accused issued cheque in question in respect of hand loan. in such situation 138 NI is attracted..
