Can someone challenge tenure transfer memo???

Department of Post recently issued a tenure transfer memo for mail overseer, marking first time in its history as there was no provision previously for tenure transfer of Mail overseers. But, no preference was taken from the mail overseers regarding their desired place of transfer by the department. Generally, for transfer of postal assistants, department of Post takes preference from the official regarding their desired place of transfer. But, in this case no preference was taken from mail overseers and they were alloted randomly to a place for transfer. One of the mail overseers who is transferred is critically ill, suffering from Coronary artery disease, high BP, Type 2 Diabetes mellitus, hypertension and many other side effects of these aforementioned diseases. Doctor has forbidden him from long journey, and he has to maintain a strict lifestyle with many restrictions on food and consuming 11 types of different medicines per day to keep his health steady. Now, he is transferred to such a place that he has to journey 9-10 hours per day to execute his duties, which is not possible for him. Also, he has no one to take care of his home and is forbidden to eat outside food by doctor. So, he has to journey from his home. Now, he has approached the authorities to consider his tenure transfer and if possible, cancel the order or to allot him a nearer office so that he has to travel less and can execute his duties properly. But they are not listening to him. What should he do now???

It is transferable job hence he cannot object or agitate over the decision of the department.

If he has any medical issues he can submit an application to get transferred to the place of his choice for the reasons stated therein on  medical grounds.

Sir, but the department and higher authorities are not listening to him and not co-operating with him. They are stubborn and doesn't want to transfer him to his preferable place, what should he do??? Can he file a plea in court???

You can file writ petition of MANDAMUS in high court against the order of department of post to get their order cancelled on the directions of high court.

Let him first apply for trransfer of place of work on medical grounds, and the if the application is rejected then he can approach either the labor court or high court with a writ petition.
