Sir,
I being a cop, investigating a case punishable under 7 years or upto 7 years have to issue 41A Crpc to the FIR named accused person as I cant arrest directly as per recent ammedment of Crpc which we all know but in a case of 467/468 IPC where punishment is more than 7 years can I issue 41A Crpc notice?Is there any legal bar for issuing or not issuing 41A Crpc in case of economic offence or any other similar offence where punishment is more than 7 years .
