498a Settlement

Dear All,

 

My lawyer says that girls family is ready to compromise provided we give Rs. 40,000 in cash and return her jewellery and some copper utensils.

Lawyer says that 498 case has to be run and then has to be dismissed after 5 hearings. I have already spent 50,000 so far. I know at every hearing my lawyer will ask for more money. I cannot afford it.

Please advice how to deal with him. How to go for settlement in 498a case.

Sectin 498-A case is non-compoundable offence (except in A.P.) and hence after reaching an agreement with the wife, prepare a signed agreement and file the signed agreement with a petition before High Court under Section 482 cr.p.c. for quashing Section 498-A FIR and criminal proceedings of the trial court.  The High Court after ascertaining the contents of petition quash the Section 498-A FIR and criminal proceedings.  In Hjigh Court you can present your self as party in person or otherwise you have to engage an advocate.  The volunteers cannot help you out by appearing themselves in the court, because they are not entitled to appear. 

There is no short cut and this is the procedure, which you have to follow if take the assistance of advocate or any voluntary organisation.
