My FIL had filed a 498a complaint at Pune in July 2011 which he never pursued. I was interrogated at PS for 3 hours after which no action was taken since he never came to Pune for a follow up. Later, he filed another 498a complaint at Amritsar which he later agreed to close after 3 mediation sessions.
Last week, he filed a case against me and five family members U/s 498a & 406 via a private complaint. I'm yet to receive the summons.
He had filed the first complaint at Pune and it is still pending.
- Considering the pending complaint u/s 498a at Pune, does the case filed via private complaint at Amritsar hold good?
- Can I use this fact to challenge the validity of case in trial court? -Or- should I approact HC/SC to prove this point?
- Considering the above facts, what should be my next steps?
