66(a) informaion technology act

A case u/s 66(A) in the Information Technology was registered in Januray-2014, a challan was produced in September -2014. In the mean time in March-2015, the Hon’ble Supreme Court struck down the unconstitutional section. But the Complainant who is fighting a divorce case against me, has never turned up in the court till date, how I square off the case?
