If the documents (sale deed)  is in the name of lawyer then legally he is the owner .He can be called morally degarded person, greedy or whatever but till there is not any sound proof that would defeat the title of sale deed which would show that he cheated nothing can be done.

What contract exists between the European person and his Indian lawyer with regard to buying the land in Goa? This transaction was purely benami in nature as the Foreigners are not allowed to buy immovable property in India and they usually do it in the form of benami manner as in this case. Benami transactions are now illegal and banned but as this was done at the time when it was legal, the money paid by European person for purchasing the property. If there exists any agreement between the parties that the manner the land will be purchased and the future use of the same, there can be some sort of legal process initiated if the Indian party is not moving ahead with the contract. Details of the contract has to be checked for providing proper guidance and legal opinion.
