Whether FIR has been registered, MLC and PM has to be conducted on the body of victim, wherein putting section and provision of law is the duty of police, accordingly punishment is prescribed in Indian Penal Code., 1860.
The accused or his relative need to defend the charge instead of getting educated.

He is liable U/S-279/304(A)IPC. The punishment is same whether he is a Govt.servant or not.He will face trial as proviso under IPC.
