To begin with, after divorce, the man and the woman concerned are not HUSBAND and WIFE.

A consensual s*x between two adults cannot be termed as Rape.  Whether it is consensual or not is to be established.  Whether the woman has made any complaint?  If not, why not?

If the she is single and if it's not forced s*x, it's not rape; what's more, it's not adultery either.

But The woman had made complaint against his exhusband that he has done s*xual intercourse with her without her consent..Then which Section 376 or 376C ipc will be filed against person ???

Essential feature of definition of rape is " s*x against the wishes of someone"    If both partners are giving voluntary permission to each other, then it can not be called Rape.  It is called Consensual Sex.
