Agreement

THERE IS A DISPUTE BETWEEN BUILDER AND PURCHASER FOR MAINTENACE.BUILER HAS INDIVIDUAL ARBITRATION CLAUSES WITH BUYER ONLY FOR TITLE NOT FOR MAINTENANCE. NOW BUYER HAVE FORMED A REGISTERED MAINTENCE SOCIETY WHICH HV FFILED CASE FOR HANDING OVER FROM BUILDER. NOW BUILDER SAYS THAT CIVIL COURT CANT DEAL WITH THIS AS MATTER SHOULD BE SETTLED BY ARBITRATOR ONLY IS IT O.K DESPITE NO AGREEMENT WITH SOCIETY SUGEST SOME JUDGMENT

You can lodge protest  with registrar of co -operative Societies ,who will issue notice to builder foor conveyance and if builder failed to satisfy the reason for not handing over the conveyance ,he will arrangge the conveyance.Ashok Trivedi Advocate
