Agreement to sell not executed

I have purchased a commercial shop in commercial Mall. 10% amount was paid intially and i signed the document application form.At that time builder promised the following.

the size sold to u is final as layout is approved by DTPC

after payment of 35% agreement to sell will be executed and finance will be available from banks.

Now even after the payment of 45% builder is not giving the agreement to sell.

three times he has sent the two copies of document and every time the shop size is changed.even after that he is not giving me the signed copy of mine of  agreement to sell.and demanding more mony with interest.

In agreement to sell i have highlighted that it is unilateral and the points discussed with me like panelty clause for not completing the project in time is not mentioned.He is niether executing the agreement to sell nor giving any satisfactory answer .I have replied to his every letter but he is not giving any satisfactory reply to my queries.

please advise , what should I do , whether to take the legal help.

You may give him notice to refund your money with interest if he is not ready to execute sale agreement  or if  in the receipt if it is mentioned that it is against the purchase price you may also give him notice for exedcution the sale agreement and then file suit for mandatory injunction and permanent injunction.
