Hi Team,

My uncle means my mothers brother has put case against my mother in court, he has issued notice from court asking for share in property, but as per will it belongs to my mother. Now after notice we will be going to court for hearing in future but my uncles presence is not mandate in the court. I came to know this from my relative Is it true?

Your relative whoever it may be is a better guide.  If anyone files a case in a court of law , his deposition with documents is mandatory as per law. Now that your mother has to respond to such notice with a befitting reply, the advocate handling the case may guide her further course of facing litigation.  You can accompany your mother and such a relative and get all doubts clarified through him.
