Ansectral agriculture property succession

The property belongs to Rajasthan.

Mr. A's name is shown in agricultue land from 1955 as per tenancy act or settlement law. The property comes in A's hand from his father is inherited. Now Mr. A expired in 1971intestate and there were three son B, C & D. In 1971 all Son partitioned property equally. Mr. C expired in 1990 intestate and the property mutated in his son and widow. There was a daughter but she was married in 1990.


The question is :

1. The property shall be ancestral in the hands of Mr. A, B, C, D ?

2. The succession act before 1956 is applicable on agriculture land which was mutated as per tenancy act or settlement law in 1955.

The property can be considered ancestral.

Your question is unclear. Succession Act is applicable as on the date of succession i.e. on succession when a person passes away.

A's father died in 1945 and Mr. A was married.
