Appearnace of councel

A dismissed employee filed an appeal. On behalf of the management, the councel who conducted enquiry against the employee appeared. Objection was made by the employee agaisnt his appearance stating that he is biased agaisnt him. Is the objection sustainable ? ,

It is against professional ethics Bias and prejudice is transparent.An advocate apppointed as enquiry officer would be biased when also appearing as Management representative before the Labour authorities.The objection raised is sustainable. (2006) 2 SCC548
