Application under order xxxiii cpc

In a civil case which is in progress and written statement has been filed and issues framed, can the plaintiff make an application for being treated as an indigent person and seek exemption in payment of court fee? The plaintiff has recently undergone an expensive medical treatment and is left with no funds of his own. He has no property or income of his own other than the old age pension of Rs. 2500/- from the State Government. He is aged 69. The residence which he stays belongs to his wife.

suit will not be numbered unless sufficient court fees is paid. Exemption of court fees is applicable only to certain persons of course with the permission of the court.. If the plaintiff is unable to bear the expenses he has 2 options.1. To go for compromise 2. to refer the matter to Lokadalat after compromise to get refund of his court fees.

you can also file application to distt. legal service authority to provide free legal aid counsel.....
