Arya Samaj Marriage Case

I want to know is the Arya Samaj marriage will count as a legal marriage if at the time of marriage the girl tell herself as not married before but in actual she is already divorced & also no one from her side present at the time of Arya Samaj marriage. will this marriage still be counted as a legitimate marriage ???

What is the difference if girl says that she is unmarried while in fact she is divorcee? In both the cases girl is "unmarried". Yes, under the given circumstances as stated in query the marriage is valid.

Well, concealment of previous marriage by one spouse would provide the other spouse with grounds for nullifying the marriage (as per section 12(1)(c) of the Hindu Marriage Act) due to fraud/misrepresentation of material fact.
