Biased and predetermined approach

Dear brothers,

There is a 7A case before REPFC. The REPFC is repeatedly telling that he has already decided the issue and if at all anything to be said, it is to be before the Tribunal. And the REPFC is reluctant and adamant in not including the Principal Employer in the said case even though t Principal Employer is ultimately responsible for any violation of EPF law by the contractor.

In this situation of the RPFC's biased and predetermined attitude what further action I can take as a Legal Counsel to the Contractor.

It appears that you are aggreived that the RPFC is not including the Principal meployer as a respondent and later on there may be a problem in recovery. If that is the case undue benfit is being caused to the Principal employer.

 

Has the assessement order been passed by RPFC? If yes only EPF Tribunal can do something.

 

In case assessemetn order is not passed you can complaint against him addressed to CVC and copy to the Chief Vigilance Officer of EPFO.
