Binding of high court judgements

 

Whether can i take Delhi High court judgement as a proof for arguing with a person whose place of business is located in chennai?

Why TAKE judgment AS PROOF?

 

Judgements can be quoted in in court proceeds. As far as circumstances of the case are same, court will take it as a precedence on which it can base its decision.

 

But, I am not sure whether you want to counsel somebody or file a case against somebody. If you want to counsel, where is the hitch? In case you want to file a case, you will have to first be sure that the case is exactly the same as that of the case on your hand.

even if the facts are not the same but a rule is made absolute, a judgement of another high court would be persuasive and not binding to the courts in the jurisdiction of chennai
