Bon

Hello All,

Following is the one Clause of my bond,

1)      The employee has indicated to company his willingness to undergo such training on the terms and conditions of aforecsaid, and has further agreed that in the event the Employee terminates, leaves and abandons his services with the company either during the training period or within a period of 24 months from the date of completion of training the Employee shall pay Entire amount of incurred for training the Employee to the Company.

Also, in my bond there nothing mention about the Notice  period min 90 days from resignation.

So my question is, Can I resign from my service within bond period?  so if i have to serve the Notice period of 90 days to company in which my 24 months of bond are completed.

also in such case, I have to pay the Bond amount to company???

Thanks in advace,

Nilesh

If notice period applicable to you is mentioned as 90 days that implies you have to tender 90 days notice of resignation or notice pay in lieu of it, when ever you resign, during the bond period or after it, unless of until notice period is changed an accepted by you.

If you resign during the bond period you are expected to pay bond amount+ notice pay for shortfall in notice period.

The company may not succeed in extracting the bond amount if training does not add to qualification or skill of the employee and the training is given on systems, products of the company, or to help to perform better.

The company may have to prove the amounts spent on training which added to qualification or skill of the employee.

You may show your appointment letter, bond, training details to a competent and experienced service lawyer.
