I am planning to purchase a land. The land details are as follows.
The land is of 7 acres
1996 - Owner 2 purchased from Three owners ( No original document, only CC copy is there)
1997 - Owner 3 purchased from Owner 2( Xerox copy they provided)
1998 - Owner 4(Five members) purchased from owner 3.
Now these 5 members have a common sale deed and each of them have a Passbook with 1.16 acres share. One of these members is trying to sell his land (of 1.16 acres).
I requested the member to get Partition deed done before purchasing. They agreed for partition deed and have done the partition.
- Can I now purchase this land ? Will this member get another passbook as they have gone for partition deed ?
- Since this is a partition deed is it ok to get CC copies of the linked documents or do I have to get all the original documents(which they might not agree as the other members aren't selling)
- Will the partition be reflected in Encumbrance Certificate ?
