Can this be challenged ?

 

We are 7 brothers and 3 sisters.  We have some ancestral property, eldest of the brothers is looking after the some legal litigation.  He remained bachelor.  He as taken our GPA and few times Special POA.

 

  1. It looks, the eldest (GPA/PPA holder) makes a Partition-deed and and give the portion  of the property to only one of the brothers, and he sells it. In thet partition deed not mentioned anything to anybody else and is not with any kind of proportion. 

    a).  Can we challnge this and request for invaildate ?

    b).  If not possible, can we challenge that he will not get any more of the proprty share ?

    c) Can we ask him to return/payback the proprty he

    Got more than his actual share ?

 

 

 

  1. Eldest brother (GPA/PPA) holder has also sold some property. 

    d). Can we challnge that it should be adjusted against his share of property.

    e). Can we ask him to return/payback the proprty he

    Got more than his actual share ?

 

 

 

  1. Eldest brother (GPA/PPA) holder has mortgaged the peropety against the loan taken by another brother.

    f). Can thet be challenged and get the mortgage challenged?
