Sir,
Wife had filed D.V. case against the husband in the month August 2014 for doing cruelty on her and she was awarded with favourable interim Order therein. The said D.V. case is still pending and she did not find any favourable action from the husband’s side to take her back because they do not want such a wife who resist cruelty.
- Now, can wife file 498a case against the husband ?
If yes,
- Whether u/s. 5 (e) of the D.V. Act, can the wife pray in the aforesaid D.V. case itself to the same Magistrate to file complaint u/s. 498a against the husband ?
