Car Accident

Hi,

We were involved in a car accident in a village. The scoter driver we had accident with had no license and was driving on the wrong side. After the accident we filed an FIR and the car was repaired and we claimed the insurance amount for the repairs.

After 2 months we have recieved a notice from the other party claiming damages of around 15 laks. The notice has our name and also the insurance companies name.

As far as my knowledge goes it should be the insurance companies duty to pay. Also should we respond to the notice or inform the insurance firm?

We are totally unaware of the procedure. Please advice.

whiile submitting the claim for your car,there is question in the claim form about third party liabilities and cause of accident.

if the incident was mentioned in the said claim and in  the FIR,you can approach the insurance company for common defence.

as per ur query the scooterist came in an wrong direction and dashed ur vechile for that u gave an police complaint and get an claim from insurance for reparing yoyr car

PLZ CLARIIFY ME:

whether the scooterist sustained any injury?

do u have an valid licence?

what the progress of an police complaint?

if u clarrify me the above questions i can adivise you .

but as per my experience i think the scooterist want to get an claim from insurance company for that purpouse he made u as a proforma paty.
