Case against manager

Hi Sir,

I am new to this forum. I would like to know what action can we take against Manager (the guy is a senior vice president) for writing abusive mails to an employee. My sister is working in reputed telecom company and is daily mentally harrassed from manager and colleague.

In fact, the HR deparment is not taking appropriate action, since he is sitting in senior position.

 

Please guide, what action can we take; we have all the written proofs.

First you have to save all the mails that recieved from the manager. Then take a print of those mails. And create a complaint petition. Annex the mails with the complaint petition. And file a FIR  against the manager in the near Police Station behalf of your sister.

Its the best way to get rid from the stupid senior workers. It will also prevent other female workers.

Download the printouts/screenshots/forward emails to personal email id,  and show these to a very able senior LOCAL counsel specializing in Labor/Service matters of unshakable repute and integrity and having successful track record……………….for a considered opinion…

There are publications suggesting that there is a purported downsizing in the segment and this might be masked effort to coerce/force/intimidate employees to leave by resignation and/or create charges of miscount to deny payouts and/or create some kind of scenario for damages…….and/or insert damaging notes/notings in personnel file for adverse comments in reference check/BGV…..

Your own counsel that has examined all docs verbatim can render a considered opinion.

Till then avoid emotional outbursts.

While posting such queries employee should post basic information!

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working? Are you under probation period or your service is confirmed in writing?

Does offer/appointment letter/contract of employment state that notice pay in lieu of notice period is not accepted?

Which is fixed pay day? Has salary not been paid on pay day?

Has salary slip been issued and supplied?

What is monthly salary?

Has company issued any notice on closure of company?

Do standing orders (model/certified) apply to establishment and your designation?

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Avoid posting photos/names/email id/phone numbers/addresses etc etc or attaching any document containing photos/names/email id/phone numbers/addresses etc etc and erase photos/names/email id/phone numbers/addresses etc etc while sending any documents to anyone, anywhere except your own very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor/service matters and having successful track record in handling such matters thru courts of law and with concerned authorities.

Online portals are not substitute for in person discussions with very able senior LOCAL counsel as explained above and are for mere getting details and directions, and guidance and for FREE. As the cause at LCI is social service and Noble cause. You are not to pay any monies for it to any IT.

 

 

 

If you wish you may attach the said emails in this thread.

However erase the names/logo/phone numbers/photos/address etc etc to maintain the confidentiality…………
