case laws regarding suupplimetory charge sheet

I have attached a copy of the AP High Court judgment on the point regarding quash of supplementary charge sheet. Since you have not provided any facts, I have just been able to find this case alone.

As u said , I did not discussed the facts of the supplimentory charge sheet hence I am giving the facts of the case as under:-

The insident took place in village,the accuseds were charged u/s 325,447,149,....of IPC,and 3(1)(x),3(1)(v),3(1)(xi) of atrosities Act of 1989.At first the accused disclosed sec. of IPC and only one sec.  3(1)(x) of  atrosity Act .The Hon'ble High court quased the sec. but their were remained other sections of said Act.

And hence the victim compel the police authority to file the supplimentery charge sheet and police filed the same.Now again accused went to High court to quash the supplimentery charge sheet.Now I want a case laws which support the supplimentery charge sheet. Thank u ur Adv. v.k. wankhede

The police have powers to file supplementary charge sheet u/s 173(8) of the Cr.P.C. A supplementary charge sheet stands on the same footing as that of a charge sheet. The points relevant for quashing the charge sheet also apply to the quashing of a supplementary charge sheet. If the accused is able to show that a good case exists for quashing the charge sheet then the High Court would definitely interfere. You have to make out your case that no grounds exist for exercising such discretion u/s 482 of the Cr.P.C.

I feel that quashing of chargesheet depends on each and every case. Only if no case is made out, the court would intervene.
