While publication of notice u/s 4, 5 & 5 (More specifically for measuring and marking of land) , is it proper and correct to the land acquisition officer that PROPOSED area under road widening should not be considered while calculating area to be acquired .
For Example
A: Total area of the land is : 25 Ares
B: Road widening (Proposed): 2 Ares : - This proposed but there is no notice or any declaration by corporation.
C= (A-B) : Net area for compensation is = 23 Ares
Is the above correct, as per me collector has to consider 25 ares of land for compensation (Not 23 Ares)
Can you pl through light on this with case laws, this most urgent
