Case withdrawal

Hi i need help on two issues.

1. I filed case against my wife for marraige nullity almost 4 years back. But during conselling sessions with marrige consellor and conversations afterwards we both understood our problems and decided to stay together and solve our problems. We stopped attending case hearings and never bothered about case. I didnt close the case. I want to know how do i close the case. Or as i have not attended hearing since last 3 years will the case be dismissed by the court by default??? Case was filed in mumbai court.

 

2. My lawyer has recently tried to contact me. In last 3 years when we didnt attend hearing he never contacted me, My all contact details were available to him but he never contacted me. Suddenly i see today he contacting me. I had payed his fees initial amount. I was not much happy with him as he was not much active(might be cause case was still with marriage consellor and never went to judge) whenever i used to call he will not pickup nor he will call back. He is one of the known lawyers around. I am worried now that he might be contacting me to ask for his fees which i dont feel worth paying as he was hardly involved and case too never went to judge where he had to work on the case. He was not much active and i was the one who will be there reminding about case hearings and etc. What shall i do. I am scared he being a lawyer may manipulate things and may make me pay huge fees. Please suggest me what shall i do.

Go to court find out status of case, in all probability the case would have gone exparte in your favour.  Best to contact ur lawyer.  Or if case is still running, then tell judge you want to withdraw it.  Court will agree.

You both did not attend the court proceedings, it means your case must have been dismissed on default. As far lawyer contacting you now after 3 years, its just to extract as much more he can from you, nothing to worry you need not bother about him, well known or not hardly matters. Just chill and be happy with your wife.
