Change Of Date of Birth & Name in Passport At Same Time

 

Sir,

I have got my passport 7 years back on the basis of my school leaving certificate, I have travelled allot on the same, untill recently i found that my DOB metioned in LC is 27/05/83 but according to my birth certificate its 22/05/83 which is correct. I have my original birth certificate as a proof for the same,I have approached my school for the mistake but they have denied to make any changes as its been long, Now i want that to be rectified in my passport and i want to change my name as well in the passport, can i do both the changes at same time.

I want to inform you that I have provided the birth certificate for my admission in school i.e. with the dob 22/05/1983. I have been with the same school since my pre primary schooling till ssc, Due to oversight of me and my parents I continued with it, where in i have found it now due to some clerical mistake in the school records they have written it as 27/05/1983. Now as they have also found so they are not helping me to get it rectified though its there mistake just not to tarnish there reputation. I would like to inform one more thing that my birth certificate is issued on the basis of affidavit by my parents which is clearly mentioned in the same.

Please suggest.



Please help me with this m really confused.

To get correct the date of birth suit for declaration and injunction is necessary, unless court decree you cannot get corrected your date of birth.

For this first u/s 80 of CPC notice has to be issued to the State Govt., Rep., by Depurty Commissioner of the Dist., and DDPI of the Dist., by giving them 60 days time to make necessary corrections in the school records.  they wont correct it  then after 60 days you will have to file a suit.  Limitation point has to be considered.  So contact your lawyer.

As per the circular of the Ministry of external affairs, 2001, Date of birth can be changed as per the document submitted by the candidate at later stage. But for Name, you need to file a declaratory suit
