Change of name post purchasing property

Hello,

I have purchased a property in 2003 along with my wife as a joint account holder. Recently my wife has changed her name to add a surname to her name (Same as mine)

We are currently going thru the entire process of changing the name to her passport, aadhar, pan etc.

What is the procedure to change the name in the society share certificate and also with the registrar for the sale deed?

1. Submit your representation for change of name of your wife in the socities share certificates and enclose relevant documents in respect of change of name. 

2. In regard to change of name in the Sale Deed, if the name was changed at a later stage then it is not necessary to change the sale deed but you get change the name in the concerned Khatha registered.

What society is it?  Is it a co-op. housing society?

Yes it is a registered cooperative society

If due procedure of name change e.g; affidavit, gazette notification has been followed the same may be submitted to society.

It may also suffice for sale deed, without need of any changes.

Or in case you prefer and seller is also willing to come forward; visit SRO and check on options e.g; correction deed

Just your wife write a letter to the Society to change her name in the records. The share certificate also can be submitted but with acknowledgment. Follow up the matter as the share certificate should not be left with the society.  It would not matter even if the name is not changed now. As regards sale/purchase deed, there is no need to take any action now. If an occasion comes to dispose of or mortgage the property appropriate sentences can be incorporated in sale or mortgage deed.
