cheating?

A man borrowed money from my father and issued receipt. But now he is not returning money and neither paying interest. He issued a cheque and a case u/s 138 is filed against him. We have learnt that he has taken money from several other persons also. These other people are willing to give witness against us as they are threatened with income tax complaint by accused. As money given by them was unaccounted. Kindly advice.

Besides cheque bounce case, you may file a money recovery suit simultaneously on the basis of the documentary evidences in your possession.
