Cheque bounce case

Hallo, our company is in receipt under 138 NI Act and the same is referred to MD of company. Queries . Does MD have to appear in this case personally or can his appearance be exempted and substituted with AR of commapny. or does MD have to appar in this case personally first and then his appearance may be exempted and substitueted with AR of company at a later stage by moviing an application for persona exemption 2 if an AR appears on behalf of company, does he have to obtain bail or he can only appear for evidence purpose kindly guide regards rohit

yes, first time the alleged person must appear after that he depute one person for appearing in future by way of power.

The appearance would be exempted after the first hearing. The lawyer's appearance would be sufficient except during the evidence. No need to apply for bail as there would be no arrest.
