Cheque bouncing and delaying the money settlement

Dear Sir,

I have booked the apartment with one of the builder around 1 year back. Builder promised he will start the construction in 3-4 months of booking date. No progress yet, infact progress is zero. As I could not wait more and had sister's marriage, I cancelled the property. The post dated cheque issued by builder got bounced and not getting proper attention from them after that. I had invested 15Lacs for this property and now I have every right to get the amount back. All amount paid is through cheque. As per builder, I have written doc saying he has to pay me the amount with interest. Please clarify below.

1. If I put a cheque bouncing case in consumer court, if builder does not respond to legal notice in 15 days, will he be punished and asked by court to pay my money with interest?

2. How much time it takes to resolve such cases? What action will be taken on him?

Please help me on this.

Hi Kiran Your case is related to cheque no consumer case File it in jurisdiction court as criminal breqch
