Chief examination

Hello, 

Can a Public Prosecutor summon & examine in Chief, an official of the Investigating Agency, whose 161 Statement is not recorded by the Investigating Officer & submitted to the Court ? No other statements such as those under 164 are submitted. There is absolutely nothing on record, except perhaps in the Case Diary which defense is not privy too.

in general, is Chief Examination permitted if an individual is named in the List of Witnesses, but the I.O has not recorded & submitted the 161/164 statementto the court.
