Civil suit recovery

Hello experts,


I have sent a legal notice for civil suit recovery to Father in Law for a recovery of 2.7lac..

I got reply from FIL stating that After the marriage I approached My Father in Law for handlone of 3lakhs.Due to the relationship FIL lends 3lakh rupees to me...and i repaid the same to my FIL...

After the misundertsanding between me and my FIL balance didn't paid and please send the balance amount..and other allegations invented by me to escape from criminal cases....

Actual fact is i ave sent this amount in 10transaction from mar 2012 to dec 2012...and my wife launched 498A and DP act 3 & 4 case against me in may 2013...

My father in law didn't gave single rupee to me after my marriage.........

in DVC my wife mentioned his father is retired employee and he can't bear my wife so expecting maintaince....in civil suit reply my FIL mentioned he is financially well settled...

1.what are the chances to my FIL on this case?

2.How he will approach next ?

3.what are my chances?

any suggestions......

Hello,

You say that you have taken a loan from your father-in-law, but that you sent a legal notice for recovery to him. You need to provide some more clarity and detail for me to help you out in your case. If you have proof that you have paid back your father-in-law and do not owe any more money to him, then you do not have any liability to him. Your loan from your father-in-law is not part of the cases filed by your wife and does not have any great impact on them. If you still have any outstanding amount left to be paid to your father-in-law, then I suggest that you try to pay that amount as quickly as possible along with the interest, or else you will have to fight two cases in two different courts simultaneously. Your chances in that are not that good if you decide to fight it by yourself. What you need is an expert lawyer who deals with these kinds of cases. If you lose the case, then you might have to pay more than 5 lakh to your wife and father-in-law in damages and fines.

Hello Sir,

Thank you for your reply and i have not taken single rupee from Father in Law...

He mentioned in the notice saying i took 3lac rupees.........Actual story is i gave him 2.74lac for chits........and send legal notice to recover the amount..........
