Clp payment schedule

Need Help....I booked a flat in Sethi Group Max Royal project in Sec 76 Noida....I made 40% payment my self....I signed the Allotment letter and on that there was Clauses written...

Delayed payment :-

Timely payment is the essence of the Allotment. The Allottees shall ensure that all payments made on or before the due date, as per the payment plan & schedule opted....

Home Loan On Flat :-

The responsibility of getting the loan sanctioned and disbursed as per the company payment plan and schedule shall rest on the Allotees.

The allottee may arrange the loan for financing his flat through own sources. the company shall extend all necessary co-operation and assitance which may include furnishing copies of required documents relating to the flat for securing theloan from financing banks.

 

I got my HDFC Home loan approval on 10th Feb and by 15 March I have to pay 50%....till now I paid 40% myself...and when I submitted all the property papers to the HDFC they asked me for NOC of loan from Dhanlaxmi bank of the project, the loan which is taken by Builder.....Builder gave me thier bank NOC on 28th March...

Now Builder is asking for 20 % payment...that means as CLP Plan they are asking for 60% payment till date...out of 60% I paid 40% and wanting HDFC to disburse 20% for me.....HDFC say's they can't ask for 60% as per CLP...they can only ask for 55%...

Now builder is trying to cancell my flat...and trying to levy 10% cancellation charges on me....as the rate in that area is incresed by 500Rs per Sq Ft....

Pls suggest me what to do with this builder anyone from Noida can help me...

The problem is the CLP Payment Schedule of Builder and HDFC is not matching....what should I do now I am salaried class can't pay the whole amount to the builder from my pocket...
