Hi Sir, My friend who lives in Gurgaon has signed an agreement or bond of three years on a plain white paper with one IT company in Pune and has given 2 post dated (Nov'15) as security cheques of 5 Lac each to this employer in order to get the UK VISA Tier 2 General. Now he is in UK and to work here and earn money he has to find a job on his own. He got a job and will start from first week of Feb'15. Now he wants to switch the employer here in UK as the VISA is transferable. Just wanted to know in case he switch the VISA , will there be any problem in India and do he need to pay the sum of 10 Lac to his current employer in any case. The bond which he has signed if for the employment in India and now he is in UK. Can he file a case against him or what all he can do in order to retain him in the same company.

The terms and conditions  printed in the bond and accepted and signed by your friend is to be seen forgiving proper opinion. However, if the bond states that the expenses borne by the company to returned by the employee if he is resigning within three years, he is bound by the contract.   The amount may be exorbitant, but is your friend admits to it then he is obliged to return the amount for violating the conditions.
