Complaint in Economic Offencr

ABC is a partnership firm in which A & B are partners. A is the working partner and B is a silent partner (housewife). A took loan from private money lender in the name of firm and has given post dated cheque of the firm. Now that private money lender has given a complaint application in Economic Offence wing. ASI is in-charge of the case is troubling and calling B to pay off the loan. What should B do to safeguard herself. Can police act as recovery agents in this case because this is completely a civil matter?

Cheque bouncing is a Criminal Offence Sec 138 and Cheating also criminal cases. Most of the Bank Loan default Cases of Nationalised Banks directly goes to CBI and you meant to say these are all Civil cases. Better discuss with a local Advocate in detail and seek the precautionery steps.

What if sir the firm is in profit as per books and the working partner has done a fraud.
