Construction of fence over boundary wall

My plot had boundary wall on 3 sides. On the fourth side had just barbed fence. Two years back, my neighbor approached us to construct stone boundary wall and fence since they have started construction in their site. We agreed that one of us will built the foundation stone wall and share the cost equally and then the other person will build the wall on top and again both parties will share the cost equally. I was asked to create the bottom stone wall and that they will build a strong wall on top of the stone wall. I got my workers to construct stone wall in my neighbours presence. Once the construction was over, my neighbour started refusing to pay for the wall.

I told them utill this is not settled, I would not allow them to construct a fence over this. Last week, they constructed wall over the stone boundary without my permission and they have not constructed it in the middle, it is towards my side taking my area.

How should I proceed legally? Should I file a case against them?

thats the only way.....seek injunction and direction for demolition
