Contempt Case when original Plaint is Dismissed in Default

 

In a Civil Suit the court grants the TI to the Plaintiff. The respondents violate the TI. However the original suit gets Dismissed in Default.

 

Question 1: Does the plaintiff lose his right to bring a contempt petition on such dismissal or the contempt proceedings can be brought against the respondents for the period in which the contempt was committed irrespective of the current status of the case?

 

Question 2: What is the Limitation to file a contempt case?

Pl give specific answer to my 2 questions . I have asked something different than what U have answered

Contempt proceeding can be initiated even if the suit is dismissed because it is order of court which has been violated and it has nothing to do with the final outcome of the case. Generally violation of the order is to be brought to the notice of the Court at the earliest when it come to your knowledge.
