Contempt of court

One of my friends is an Litigant in Hon'ble Supreme court of India..... In case a an affidavit has been filled by the respondent in response to the SLP. In this affidavit the Respondent has falsely given an some information which is wrong and is amounting to scandalizing the Hon'ble High court. Will this amount to the contempt of the highest court of this Land.

Please advise. Can the respondent be prosecuted U/S 181,182 and 191 of IPC.

In the same case one Affidavit is missing from the files of Hon'ble High court. Can we file a case u/s 201 IPC against the unidentified person...please advise

Instead of filing criminal case directly, you can bring this fact in the knowledge of High Court and may pay to initiate legal action against the responsible person/accused.

 

So far as the proceedings of SC are concerned, you may file an applcation under section 340 Cr. PC therein so that such deponent may be punished accordingly. Definitely such things especially misleading Highest Court amounts to contempt of court.

Sir, We have wriiten a letter to cheif Justice of Hon'ble High court and copies has been marked to Hon'ble Cheif Justice of India. This was a labor matter was decidede by CGIT in favour of workman and then the respondebnt filled writ in which they succeded and subsequently the Petitioner filled a Appeal. The Petitioner lost in appeal and filled a Review. The Review also got dismissed and then the Petitioner has approached the Hon'ble Supreme court of India with 12 question of Law....

Giving false information in affidavit is a contempt of court. You can file a petition u/s 340 cr.p.c. seeking prosection on the respondent.

Dear Raj Sir / Arunagiri SIr,

Thanks a lot for showing us the way. But we have already written a letter to Hon'ble Cheif Justice of India and Hon'ble Cheif Justice of High court. Will the respected Judges take action on this complaint.

The SLP No 4217 -4218 is commin on board on 19.09.2011 in the Hon'ble Supreme court.

We are approaching Hon'ble Supreme court with contempt petition....The fight is for the justice and is not only ours, It will be the fight for all the people who would like to join us from wherever they are.
