File RTI Application seeking for a certified copy of such granted to an extent of .................Ac in Survey No...............of ...............village,.............District, and all the revenue records that state ownership and enjoyment of that piece of land as the certificate was missing.

Thank you sir for the reply. I've already applied an RTI and have received a reply stating that the grant copy and 11 E sketch are missing in the Taluk office.

You have to escalate to First Appeal and Second Appeal also as those records are permanent in nature and in case of 'missing ' a complaint has to be filed to Police.

Brief Facts; Appellant has filed application on....................seeking information under RTI Act for a certified copy of the Grant and 11E sketch in Survey No...................... at....................
SPIO has replied stating that the grant copy and 11 E sketch are missing in the Taluk office.
Grounds for Appeal: Information can only be denied as per Sec. 8 (1) of exemptions under RTI Act. "Missing records" is not treated as a denial of information. As per several CIC decisions and Court judgments, after the knowledge of missing records, a complaint has to be filed with Police and efforts must be made to regenerate/rebuild records as expeditiously as possible, and the applicant has to be provided information on such reconstructed record.
PRAYER: Appellant prays for directions to SPIO for filing a Police complaint on such missing records, if not already done, and for orders for the building of such records, as these records are permanent in nature, connected with revenue matters, and the public are subjected to great inconvenience as these are vital to establishing lawful title.
