THE FATE OF 138 CASE IN WHICH ACCUSED DIES

1.            Section 138 - Complainant - Death during pendency of proceedings - Not necessary that legal heirs or legal representatives only can continue the proceedings - A fit and proper person can be permitted to prosecute the petition. 2. Section 138 - Complainant - Death during pendency of proceedings - Sister - Can be allowed to continue the proceedings when legal heirs do not chose to come on record to prosecute the petition. 3. Section 138 - Complainant - Death of - Complaint does not ipso facto terminate or abate upon death of complainant - Where complainant is dead, his legal representative, agent or power- of- attorney holder can be permitted to prosecute complaint. Dear friends,

Question is very clear. a complaint case in which accused is died and not the complainant. Complainant can be substituted but not the accused. Once the accused is dead, the case is abated. It is very clear.

These are the Criminal proceedings and all the Criminal Proceedings are abated when the accused dies during pendency of trial and likewise in 138 Cases, the case would certainly abate and the legal heirs of accused cannot be substituted..

will u pl quote the relevant sec either IPC or CrPC, wherein the death of the accused causes abatement of the case? Sec 394 of Crpc deals only with abatement of appeal.
